Eksistensi Hak Atas Kekayaan Intelektual Terhadap Hukum Siber, memiliki kedudukan yang khusus  mengingat kegiatan siber sangat lekat dengan pemanfaatan tehnologi informasi  yang berbasis pada Hukum Hak Cipta, Merek, Rahasia Dagang yang masih mengalami kesulitan dalam melakukan penegakan hukum terkait pembuktian apabila terjadi kasus-kasus hukum seperti, Rahasia Dagang yang terdapat dalam komputer dan jaringan internet, Desain Industri melindungi dengan tampilan tampilan seperti homepage.

Penerapan asas-asas Yuridiksi dalam ruang siber menurut Hukum Internasional antara lain dengan menggunakan tiga jenis Yuridiksi untuk menetapkan Undang-undang (the yurisdiction to prescribe), Yuridiksi untuk Penegakan Hukum (the yurisdiction to enforce) dan yurisdiksi untuk menuntut (the yurisdiction to adjudicate)

ABSTRACT

Existence of Intellectual Property Rights Against cyber Law , has a special position considering the cyber activities is closely linked to the utilization of information technology based on the Copyright Law, Trademark , Trade Secret are still having troubles in performing law an forcment associated with evidence in the event of legal cases such as , Trade Secrets  in the computers and internet networks , industrial designs protected with displays  like homepage.

The Application of the jurisdiction principles  in the cyber space according to the International Law, among others, by using three types of jurisdiction that is  (the yurisdiction to prescribe) , Jurisdiction for Law Enforcement (the yurisdiction to enforce) and the jurisdiction to prosecuting (the yurisdiction to adjudicate)
